Terms of Service

These Terms of Service ("Terms") govern your use of the Trivia Stakes mobile application and related services (the "App"), provided by TonTech ("we", "us", "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you are a minor, you may only use the App with the consent and supervision of a parent or legal guardian.

2. The game — play chips, no real money

Trivia Stakes is a skill-based trivia game. "Chips" used in the App are virtual play tokens for entertainment and scoring only. Chips:

have no real-world or monetary value;
cannot be purchased, redeemed, withdrawn, won, or transferred for money or anything of value; and
exist solely as a scoring mechanic (the "wager", speed multiplier, and similar features measure confidence and skill, not money).

The App is not a gambling product and offers no real-money wagering.

3. Your account

Anonymous play is available by default. If you sign in or create an account, you are responsible for activity that occurs under it and for keeping any sign-in method secure. You may delete your account and associated data at any time from within the App (Settings → Account → Delete Account); see our Privacy Policy.

4. Subscriptions, purchases, and billing

The App offers optional auto-renewable subscriptions (Stakes Plus and Stakes Pro) and optional one-time purchases (such as a per-topic creation credit). All purchases are processed by the platform app store (Apple App Store or Google Play), not by us.

Auto-renewal. Subscriptions automatically renew at the then-current price for the same period unless cancelled at least 24 hours before the end of the current period.
Managing and cancelling. You manage or cancel subscriptions in your Apple ID or Google Play account settings. Deleting the App does not cancel a subscription.
Prices and changes. Prices are shown in the App before purchase and may change for future billing periods, subject to applicable store rules.
Refunds. Refund requests are handled by the applicable app store under its policies; we do not separately process payments or refunds.
Consumable credits. One-time "create a topic" credits are consumed when a topic is saved and are non-refundable once used, except where required by law.

Your purchases are also subject to the terms of the app store you purchased through (for example, Apple's Licensed Application End User License Agreement, or the Google Play Terms of Service).

5. User-generated content (Community Topics)

The App lets eligible users create trivia topics and optionally share or publish them ("User Content").

Your responsibility. You are solely responsible for User Content you create and confirm you have the right to submit it.
License to us. You grant TonTech a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content within the App for the purpose of operating and promoting the service. You retain ownership of your User Content.
Zero tolerance for objectionable content. Published User Content is screened before others can see it, and we do not tolerate objectionable content. You must follow our Community Content Policy, which is incorporated into these Terms. We may remove content and suspend or terminate accounts that violate it.
Reporting and blocking. You can report any community topic from within the App and block creators. We act on reports of objectionable content within 24 hours.

6. Acceptable use

You agree not to:

use the App for any unlawful purpose or in violation of these Terms;
submit content that is illegal, hateful, harassing, sexually explicit, violent, deceptive, or otherwise objectionable;
attempt to cheat, manipulate leaderboards, reverse engineer, or interfere with the App's security or integrity; or
use the App to infringe the intellectual property or privacy rights of others.

7. Intellectual property

The App, including its software, design, trademarks, and original content (excluding User Content), is owned by TonTech and protected by applicable laws. We grant you a limited, personal, non-transferable, revocable license to use the App for your own non-commercial entertainment, subject to these Terms.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that trivia content is complete or accurate.

9. Limitation of liability

To the maximum extent permitted by law, TonTech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or the Community Content Policy. You may stop using the App and delete your account at any time.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice in the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
